Every state is different, and Maryland’s pool fence laws are definitely not the same as Arizona’s or New York’s.

It’s no secret that everyone gets excited about outdoor fun as the weather warms. Many love swimming and start to plan their own personal pools. However, owning a pool is not all fun and games and there are numerous laws which must be followed and precautions which must be taken. Every state is different, and Maryland’s pool fence laws are definitely not the same as Arizona’s or New York’s. This may seem like a lot of fuss, but it is a serious safety issue. According to the CDC, accidental drowning is the leading cause of death for children between the ages of 1-4. Many of these children die in swimming pools. This is why it is important to make sure you are aware of pool fence laws before you build one.

When Exactly Do You Need A Pool Safety Fence?

According to the 2012 International Residential Code and structure meant for swimming with water 24 inches deep or more in it located at a single or two family dwelling requires a fence. This has been written into law all across Maryland.

Specific Pool Fence Laws

A pool fence must be 48 inches tall minimum with pickets spaced no more than 4 inches apart. All access gates must also be self-closing, self-latching, and have a locking device. This will ensure that no one can sneak into your pool and accidentally hurt themselves. Above ground pools taller than 48 inches, however, do not require a fence if their ladder is detachable. If a pool is shorter than 4 feet tall, a barrier should be installed to make the pool walls a safer height.

While certain laws are universal across the state of Maryland, others will vary according to the county you live in. It is important to follow both state and local laws when building a pool and/or pool fence. Check with your local jurisdiction.
